ICCAT is an inter-governmental fishery organization responsible for the conservation of tunas and migratory species in the Atlantic Ocean and its adjacent seas which includes the Gulf of Mexico and the Mediterranean Sea. The 40-year old commission includes nearly 50 member nations.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;span style="color: black;"&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;As the negotiations opened, intense media attention was directed at the U.S. and &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;&lt;b&gt;Dr. Jane Lubchenco&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;, Administrator of the National Oceanic and Atmospheric Administration (NOAA). Lubchenco’s presence was a clear indication that the U.S. was increasing its visibility at ICCAT. She delivered the U.S. conservation message as one, supporting science-based management for sustainable stocks and long term fishing opportunities and jobs for both the recreational and commercial fisheries. &lt;/span&gt;&lt;/span&gt;“&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;This was the first time we have heard a clear statement emphasizing the economic and cultural value of recreational fishing being delivered by the U.S. at ICCAT,” said &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;&lt;b&gt;Ellen Peel&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;, TBF President, who served as the U.S. Recreational Fishing Commissioner. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt; &lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;span style="color: black;"&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;&lt;b&gt;Randi Parks Thomas&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;served as the U.S. Commercial Fishing Commissioner and &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;&lt;b&gt;Russell Smith,&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt; NOAA’s Deputy Assistant Secretary for International Fisheries, was the lead U.S. Commissioner and negotiator. &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;&lt;b&gt;Dr. Russell Nelson&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;, TBF’s Chief Scientist, represented the organization as an official observer lobbying for conservation and keeping anglers globally informed via TBF’s blog site &lt;a href="http://thebillfishfoundation.blogspot.com/"&gt;http://thebillfishfoundation.blogspot.com&lt;/a&gt; . Some positive results included a continuing of Atlantic marlin conservation measures requiring release of live marlin from longline vessels and quotas on commercial landings. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt; &lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;span style="color: black;"&gt;“&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;These conservation measures have resulted in the first positive increase in white marlin stocks in over three decades,” noted Peel. “Negotiating before ICCAT for the conservation of species important for U.S. recreational fisheries is extremely challenging,” she said “but in recent years Brazil has arisen as a very important partner in billfish conservation.” &lt;/span&gt;&lt;/span&gt;“&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;The U.S. successfully managed to extend the North Atlantic swordfish measures for one year, which will likely create more pressure next year to retain quota share,” observed Nelson, “and any reduction in U.S. quota share would trickle down to re-distribution of catch allocations through all user groups in the U.S.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div align="LEFT" style="margin-bottom: 0in;"&gt;&lt;span style="color: black;"&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;In other major news ICCAT, which recently began addressing shark conservation, removed oceanic whitetip and hammerhead sharks from the international market and any take, possession or sale will be prohibited (with some exceptions for small scale artisanal coastal fisheries). On the down side for sharks measures to protect thresher and porbeagle sharks and to require that all sharks be landed with fins intact (to make it harder to fin sharks and discard their bodies) were defeated. Like marlin, sharks are killed as bycatch in pelagic longline gear. &lt;/span&gt;&lt;/span&gt;“&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;A significant step was achieved with the adoption of the agreement to prohibit retention of oceanic whitetip sharks,” said &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;&lt;b&gt;Sonja Fordham&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: Arial;"&gt;&lt;span style="font-size: x-small;"&gt;, a veteran international shark expert, U.S. delegation member and President of the non-profit organization Shark Advocates International. Then you buy  your tags on the type of fish you wish to fish for. Again, another tag  to keep the uncaught fish good only for the days you plan on fishing.  Now you put in for a lottery type drawing to see if you can fish that  particular piece of water and that is a non-refundable fee. Then you get  a day license to fish where you put in for if your accepted and that is  for angling on Public lands. Private land fishing is the same except  higher cost. Catch Shares on freshwater or salt are the amount allowed  and the season. Sector Separation are areas divided up, leased to the  highest bidder and they are the ones giving permission on where to how  you can fish. That is it in a nutshell but it dwells much deeper than  that under Article 21 of the United Nations Land, Ocean, Sea, Treaty  LOST. It passed the House as an earmark in the middle of a 2,990 page  Bill. Who reads that? Apparently nobody we elected because LOST was  passed in the House, is now up to the Senate and if passed, President  Obama has said he will sign it into law. The Law of the Sea Treaty calls for technology transfers and wealth transfers from developed to undeveloped nations. Its scope is vast: it covers all ocean  space, with all its uses,  including navigation and overflight; all uses of all its resources,  living and non-living, on the high seas, on the ocean floor and beneath,  on the continental shelf and in the territorial seas; the protection of  the marine environment; and basic law and order.... The Convention is  widely recognized by the international community as the legal framework  within which all activities in the oceans and the seas must be carried  out. DOALOS, the UN agency in charge of administering LOST, claims the  convention covers "all ocean space," including everything on, in, under,  and above the oceans. Note also the heavy use of the adjective "all,"  as in "all uses," "all resources," "all activities." There have been a lot of concerns lately about fishery closures affecting Florida, whether in the Gulf of Mexico or the Atlantic Ocean. Because fishing is so important to our State, it is vital that we find a way to preserve public access to our fisheries, so that our kids and grand kids can enjoy the same fishing trips and fresh Florida seafood that we have enjoyed.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/div&gt;&lt;div style="margin-bottom: 0in; text-decoration: none;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="margin-bottom: 0in; text-decoration: none;"&gt;&lt;span style="color: black;"&gt;&lt;span style="font-family: Times New Roman;"&gt;&lt;span style="font-size: small;"&gt;&lt;span style="font-style: normal;"&gt;&lt;span style="font-weight: normal;"&gt;As you know, the Magnuson-Stevens Act requires that regional fishery management councils end overfishing. I support curbs to end overfishing, but I am concerned that too often these decisions are being made on limited and sporadic data. I believe we really have to look again at the science and make sure we’re not putting Florida’s fishing industry in serious jeopardy. That is why I filed the Fishery Conservation Transition Act (S. 3594). This bill would provide time for the science to catch up, giving resource managers an opportunity to develop creative measures to conserve the resource, require accountability, and still also allow access. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt; &lt;/div&gt;&lt;div style="margin-bottom: 0in; text-decoration: none;"&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="margin-bottom: 0in; text-decoration: none;"&gt;&lt;span style="color: black;"&gt; &lt;span style="font-family: Times New Roman;"&gt;&lt;span style="font-size: small;"&gt;&lt;span style="font-style: normal;"&gt;&lt;span style="font-weight: normal;"&gt;I’ve also called on the Senate Commerce Committee to hold an oversight hearing on the recent closures affecting Florida and how the Magnuson-Stevens Act is being implemented. Bill Nelson of Florida&lt;br /&gt;(S3594) and Rep. Dan Boren of Oklahoma (HR6316) are supported by trade groups ASA and NMMA, but I&lt;br /&gt;wonder if the anglers themselves are really aware of what’s actually contained in the legislation,” Donofrio said.&lt;br /&gt;According to the ASA’s Keep America Fishing website, the Nelson/Boren legislation gives NOAA “the time,&lt;br /&gt;resources and guidance” to meet its responsibilities to properly implement Magnuson “in the manner in which it&lt;br /&gt;was originally envisioned by Congress in 2006.” However, Donofrio said it was Congress that originally passed&lt;br /&gt;this faulty legislation without discussion. “The Nelson/Boren legislation provides cover for NOAA to keep&lt;br /&gt;stalling, yet it fails to address accountability measures, arbitrary deadlines and statutory overfishing definitions&lt;br /&gt;contained in Magnuson which are actually destroying our industry,” Donofrio said. “ASA called Magnuson a big&lt;br /&gt;win for the sportfishing industry in 2007, yet fishermen have been losing access because of it ever since,” he said.&lt;br /&gt;RFA has actively lobbied for congressional efforts to counteract these overly-restrictive measures through support&lt;br /&gt;of legislation sponsored by Rep. Frank Pallone to add flexibility to federal rebuilding timelines (HR1584) and by&lt;br /&gt;Rep. John Mica (HR3307) which could’ve limited the authority of the Secretary to shut down the South Atlantic&lt;br /&gt;red snapper fishery without improved studies. While the Pallone bill had a Senate companion bill sponsored by&lt;br /&gt;Sen. Charles Schumer (S1255), efforts to find a Florida Senator to sponsor a companion to the Mica bill were&lt;br /&gt;unsuccessful in advance of the controversial Amendment 17A and the red snapper closure.&lt;br /&gt;“For three years, the industry’s trade association has fought our efforts to reform Magnuson, while only recently&lt;br /&gt;throwing their own personal support into lame-duck session bills by Sen. Nelson and Rep. Boren,” Donofrio said.&lt;br /&gt;“The real problem is the Nelson/Boren bills will not help keep Americans fishing but instead will pay a handful of&lt;br /&gt;fishermen not to fish.”&lt;br /&gt;According to the RFA, the Nelson/Boren legislation would actually amend the emergency action section of&lt;br /&gt;Magnuson to broaden the definition of an emergency situation, providing NOAA with even more justification to&lt;br /&gt;close down fisheries while granting the Commerce Secretary with increased authority to declare emergencies.&lt;br /&gt;Theoretically, Donofrio says such an amendment could allow NOAA the discretion to adjust landings more&lt;br /&gt;quickly in favor of fishing communities, but he points out how the current NOAA Administration has proven very&lt;br /&gt;little ‘positive’ history with fishermen to take such initiatives. “Amending federal law to give NOAA power to&lt;br /&gt;shut down fisheries more quickly when the flawed harvest projections show harvest limits might be met is a&lt;br /&gt;recipe for economic disaster, just ask the operators of our black sea bass fleet,” Donofrio said.&lt;br /&gt;Page 1 of 2&lt;br /&gt;&lt;div style="text-align: center;"&gt;&lt;b&gt;PRESS RELEASE&lt;/b&gt;&lt;br /&gt;&lt;b&gt;Recreational Fishing Alliance&lt;/b&gt;&lt;br /&gt;&lt;b&gt;5724 N. For information, call 888-JOIN-RFA or visit www.joinrfa.org.&lt;br /&gt;RFA said the bill would also amend Magnuson to allow the Commerce Secretary to make payments to fishermen&lt;br /&gt;affected by those Magnuson provisions calling for an end of overfishing, but it fails to address the underlying&lt;br /&gt;problem of why fishermen are not actually allowed access to these fisheries. “The bill is actually written so that&lt;br /&gt;the only fishermen offered government handouts are those fishing under specific sections of Magnuson,”&lt;br /&gt;Donofrio said, pointing where the bill specifically addresses fisheries consistent with that part of Magnuson that&lt;br /&gt;uses annual catch limits in their management plans. “What these bureaucrats can’t seem to comprehend is that our&lt;br /&gt;fishermen aren’t looking for government handouts, they’re simply asking the government for a hand so that we&lt;br /&gt;can continue to fish,” Donofrio added.&lt;br /&gt;RFA says to qualify for federal assistance under to the Nelson/Boren plan, a fishery would have to be completely&lt;br /&gt;closed (no retention), the stock would need to be classified as experiencing overfishing, and the closure would&lt;br /&gt;have to be in place for an entire fishing season. “For our Northeast and Mid-Atlantic fishermen, sea bass would&lt;br /&gt;not qualify for assistance, neither would our South Atlantic grouper fishermen who are being shut out of certain&lt;br /&gt;fisheries due to the deepwater closure there,” Donofrio said. “This bill is nothing but a fisheries shell game, and it&lt;br /&gt;certainly doesn’t keep anyone actively fishing.”&lt;br /&gt;In terms of providing economic assistance, the bills describe how permit fees would go into the Fisheries&lt;br /&gt;Conservation and Management Fund first created under section 208 of Magnuson. Donofrio said the&lt;br /&gt;Nelson/Boren legislation would amend how that fund is managed, making it more robust when any permit fees&lt;br /&gt;are increased. “Being as how recreational anglers are the largest fishing constituent group though we’re not&lt;br /&gt;currently under a permit program is a bit troubling,” Donofrio said. “This is perfect language for catch share&lt;br /&gt;advocates who would like to push for recreational permit programs to increase the balance of the Fund,” he said.&lt;br /&gt;There’s also additional language related to state matching funds whereby states would be required to pay out&lt;br /&gt;additional assistance to fishing communities once the federal responsibilities are met. “Considering the lack of&lt;br /&gt;surplus in most state budgets, it’s unlikely many of our coastal states could meet this matching fund requirement,&lt;br /&gt;meaning we can expect to see an expanded push for increased permit fees at the state level, perhaps even&lt;br /&gt;recreational permit programs to drive revenue,” Donofrio said.&lt;br /&gt;Recent press releases supporting the Keep America Fishing web campaign have hyped it as the ‘voice of the&lt;br /&gt;American angler,’ which RFA says is mostly market-speak. “The tackle industry trade publications are calling&lt;br /&gt;this a ‘brand’ which tells me as much as I need to know,” said Jim Hutchinson, Jr., Managing Director of the&lt;br /&gt;RFA. “I spent years in the business of marketing and branding, and what our fishing industry needs now is a&lt;br /&gt;backbone, not a marketing campaign,” he said.&lt;br /&gt;According to Hutchinson, Keep America Fishing is aimed mostly at casual fishermen and Internet browsers, what&lt;br /&gt;one industry insider described as Lunchbox Larry types. “These boardroom executives think of our saltwater&lt;br /&gt;anglers as inactive, unmotivated rubes who could care less if they catch anything,” Hutchinson said. “Our&lt;br /&gt;hardcore RFA members don’t simply want a boat ride experience with friends and family, they want to be able to&lt;br /&gt;hunt down and harvest some fish once in awhile.”&lt;br /&gt;Hutchinson explains that there are no Keep America Fishing activists, no lobbyists, no fisheries experts or staff&lt;br /&gt;scientists, “it’s simply a marketing ploy run by an ad agency hired to make the trade association look like it’s&lt;br /&gt;doing something to protect the rights of anglers,” Hutchinson said, adding “this is the same group which told the&lt;br /&gt;industry not to join the RFA at our national rally in DC, who believed that a national demonstration wouldn’t&lt;br /&gt;work, and who’s now trying to pass off a web page as grassroots activism, I think it’s deplorable,” he said.&lt;br /&gt;“Fishermen who signed up for Keep America Fishing email campaigns as are now united under one voice with a&lt;br /&gt;group which openly supported the restrictive language written into Magnuson in 2006 and is now advocating for&lt;br /&gt;building broader private angler support for catch shares in 2010,” Donofrio added.&lt;br /&gt;&lt;span style="color: black;"&gt;&lt;span style="font-family: Times New Roman;"&gt;&lt;span style="font-size: small;"&gt;&lt;span style="font-style: normal;"&gt;&lt;span style="font-weight: normal;"&gt; &lt;b&gt;"&lt;i&gt;Gee Bill, all that rocking back and forth on that fence must make your ass awful sore; why not come to the Light side and fight evil rather than even consider the Dark side and lose your next election!"&amp;nbsp; Gary A. This is the eleventh reopening  in federal waters since July 22. &amp;nbsp;This reopening was announced after  consultation with the U.S. Food and Drug Administration and under a  reopening protocol &amp;lt;&lt;a href="http://www.fda.gov/Food/ucm217598.htm" target="_blank"&gt;http://www.fda.gov/Food/&lt;wbr&gt;&lt;/wbr&gt;ucm217598.htm&lt;/a&gt;&amp;gt;  &amp;nbsp;agreed to by NOAA, the FDA, and the Gulf states. &amp;nbsp;The total area  reopened today is about 3.5 percent of federal waters in the Gulf of  Mexico and 89 percent of the current closed area, as last modified on  October 22. No oil or sheen has been documented in the area since July  25. &lt;br /&gt;&lt;br /&gt;At its closest point, the area to be reopened is about 10 miles from the  wellhead. NOAA sampled this area between August 31 and November 1 for  finfish and shrimp, including tuna, swordfish, escolar, and royal red  shrimp. Sensory analyses of 286 finfish samples and 55 shrimp samples  and chemical analyses of 207 finfish samples in 33 composites and 50  shrimp samples in nine composites followed the methodology and  procedures in the reopening protocol, with sensory analysis finding no  detectable oil or dispersant odors or flavors, and results of chemical  analysis for oil-related compounds and dispersants well below the levels  of concern. &lt;br /&gt;&lt;br /&gt;“This is the first reopening where we have added a supplemental test to  detect dispersants in seafood, and all the samples passed,” said Jane  Lubchenco, Ph.D., under secretary of commerce for oceans and atmosphere  and NOAA administrator. “This is yet another indication that our Gulf  seafood is safe for consumption.” As announced on October 29, 2010, NOAA  and FDA have developed and implemented a chemical test to detect the  presence of dispersants in fish, oysters, crabs and shrimp. The level of  concern for dispersants is 100 parts per million for finfish and 500  parts per million for shrimp. The test can reliably detect Dioctyl  sodium sulfosuccinate (DOSS) at levels of 2000 times below the lowest  level of concern. &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;br /&gt;&lt;br /&gt;NOAA continues to work closely with the FDA and the Gulf states to  ensure seafood safety. NOAA and FDA are working together on broad-scale  seafood sampling that includes sampling seafood from inside and outside  the closure area, as well as dockside and market-based sampling. An area  covering 1,041 square miles immediately surrounding the wellhead,  remains closed to fishing. The boundary of the fishery closure has  changed 32 times after it was first instituted on May 2, at which time  it covered about 3 percent (6,817 square miles) of Gulf waters around  the wellhead. As oil continued to spill from the wellhead, the area grew  in size, peaking at 37 percent (88,522 square miles) of Gulf waters on  June 2.
